
14 Democrat state attorneys general sued Trump and DOGE and claimed Elon Musk is operating with unchecked power since he is not senate confirmed.
Blue states such as Arizona, Michigan, Rhode Island, New Mexico, Massachusetts and others filed a lawsuit arguing President Trump violated the Appointments Clause of the Constitution when he created DOGE and gave Elon Musk โunchecked power.โ
The attorneys general argued that since Elon Musk is not senate confirmed, he should be barred from issuing orders to anyone inside of the executive branch.
โWe are asking the court to invalidate his directives and actions and to issue a restraining order,โ Michigan AG Dana Nessel wrote, according to AP.
The White House responded to the latest Democrat lawfare.
White House Press Secretary Karoline Leavitt said the latest lawsuit is a โcontinuation of the weaponization of justice against President Trump.โ
โThe White House will continue to fight these battles in court, and we expect to be vindicated,โ Leavitt said in a statement.

A group of 14 states sued Elon Musk and President Donald Trump on Thursday, arguing that the authority the White House granted the tech billionaire and his advisory Department of Government Efficiency is unconstitutional.
The suit, filed by Democratic attorneys general from states like Arizona, Michigan and Rhode Island, takes aim at the magnitude and scale of Muskโs power, noting that DOGE has led the Trump administrationโs efforts to dramatically reduce the size of the federal workforce, dismantle entire agencies and access sensitive data.
โThe founders of this country would be outraged that, 250 years after our nation overthrew a king, the people of this countryโmany of whom have fought and died to protect our freedomsโare now subject to the whims of a single unelected billionaire,โ Arizona Attorney General Kris Mayes said in a statement.
The attorneys general argue that Trump violated the Appointments Clause of the Constitution by creating DOGE โ an unofficial government agency โ without congressional approval and by granting Musk โsweeping powersโ without seeking the advice and consent of the Senate through a confirmation hearing.
