West Virginia Governor Patrick Morrisey has signed into law a bill that legally defines the terms “man” and “woman” strictly based on reproductive biology.
The bill clearly defines the sexes based on reproductive organs at birth, not gender identity.
“West Virginia will not bow down to radical gender ideology,” Morrisey said while signing the bill.
Under the law, the state of West Virginia defines a man as an individual who was born with male reproductive organs, and a woman is an individual whose reproductive system has female reproductive organs.
The law also states that multi-occupancy facilities, including restrooms and locker rooms, must be designated for either sex.
“It’s common sense that women’s spaces, like bathrooms, locker rooms, domestic violence shelters, and rape crisis centers should be kept private for women only,” Morrissey said.
Democrats had argued that the bill would allow schools to examine children’s genitals, but it was amended to specify that “a minor’s sex would be verified using their birth certificate.”
“Biological sex of a minor would be determined at the time of the minor’s birth,” West Virginia Senate Majority Leader Patrick Martin explained.
