President Joe Biden’s push for Supreme Court term limits and an ethics code is nothing but political grandstanding, says retired Judge Andrew Napolitano. Speaking on Newsmax’s “Wake Up America,” Napolitano declared Biden’s proposal “dead in the water.”
Napolitano broke down the significant hurdles: “Amending the Constitution requires a two-thirds majority in both houses of Congress. That alone makes Biden’s plan DOA.” He added, “Even if by some miracle Congress agrees, three-quarters of state legislatures would need to ratify it. It’s just not going to happen, especially not during Biden’s presidency.”
Biden’s proposal, which also includes limiting presidential immunity following the Supreme Court’s recent ruling in Trump’s favor, is seen by Napolitano as a political maneuver. “The left is still fuming over the Roe v. Wade reversal. This is their strategy to keep the issue alive during the upcoming presidential campaign,” he said.
Highlighting the political nature of Biden’s move, Napolitano referred to Justice Sonia Sotomayor’s dissent in the immunity ruling. “Her dissent was fiery. She didn’t even use the customary ‘I respectfully dissent,’ signaling deep disagreement with her colleagues,” Napolitano explained.
Napolitano also pointed out the irony in Biden’s stance on presidential immunity. “Biden should actually appreciate the immunity decision. It shields him from prosecution for any actions taken while in office. Yet, reversing this would again require a constitutional amendment. It’s not feasible, but it stirs up debate the Democrats believe will benefit them politically.”
This analysis by Judge Napolitano, originally reported by Sandy Fitzgerald for Newsmax, underscores the constitutional challenges and political theater surrounding Biden’s recent Supreme Court proposals.
