Judge Paula Xinis, an Obama appointee, erupted on the Trump Administration after a conference to address the governmentโs dispute over discovery in the Kilmar Abrego Garcia case.
The judge accused the Trump Administration of defying her court order and ordered the government to provide more details by Wednesday about its decision to send Abrego Garcia to CECOT.
Kilmar Abrego Garcia is an El Salvadorian national who was illegally residing in Maryland. In 2019, an immigration judge ordered Abrego Garcia, an alleged member of the dangerous MS-13 gang, removed from the US. Additionally, an immigration appellate court also upheld the immigration judgeโs decision.

The Trump Administration deported Abrego Garcia to El Salvadorโs CECOT prison after he was given โdue process,โ however, a legal battle over the MS-13 gang memberโs fate is playing out in the courts.
The Supreme Court muddied the case even more after it ordered the Trump Administration to โfacilitateโ the release of Abrego Garcia. The high court, however, said in its ruling, โwith due regard for the deference owed to the Executive Branch in the conduct of foreign affairs.โ
A dispute over discovery in the Abrego Garcia deportation case escalated after the government maintained that providing certain details are an invasion of diplomatic discussions.
Attorneys for Kilmar Abrego Garcia on Monday accused the government of stonewalling its effort to obtain more details on Garciaโs deportation to El Salvador.
On Tuesday, Judge Xinis accused the Trump Administration of acting in โbad faithโ and โobstructingโ efforts to gather more information on its decision to send Abrego Garcia to CECOT.
The judge also ordered the Trump Administration to provide more details about the contract the US government has with El Salvador.
โDefendantsโ objection reflects a willful and bad faith refusal to comply with discovery obligations. The objection is overruled. Defendants are therefore ordered to supplement their answers in full compliance with the Federal Rules of Civil Procedure. Their answers must include facts responsive to the requests, not oblique and incomplete, non-specific characterizations,โ Judge Xinis wrote in an 8-page order reviewed by The Gateway Pundit.
