Radical Left Colorado AG Says Trump’s Pardon of Gold Star Mom Tina Peters WON’T WORK

President Donald Trump on Thursday granted a full pardon to Tina Peters, a Gold Star mother, election integrity advocate, and former Mesa County Clerk who has been languishing in a Colorado state prison for daring to challenge the 2020 election.

Peters, who is 69 years old and in poor health, is currently serving a nine-year sentence on state charges related to her efforts to investigate election systems following the highly disputed 2020 presidential election.

Despite her age, medical condition, and status as a Gold Star mother, the radical left has shown zero mercy.

Last week, a magistrate judge dismissed Tina Peter’s habeas corpus petition seeking an early release from prison.

President Trump did not mince words when announcing the pardon on Truth Social.

“For years, Democrats ignored Violent and Vicious Crime of all shapes, sizes, colors, and types. Violent Criminals who should have been locked up were allowed to attack again. Democrats were also far too happy to let in the worst from the worst countries so they could rip off American Taxpayers,” Trump said.

“Democrats only think there is one crime – Not voting for them! Instead of protecting Americans and their Tax Dollars, Democrats chose instead to prosecute anyone they can find that wanted Safe and Secure Elections. Democrats have been relentless in their targeting of TINA PETERS, a Patriot who simply wanted to make sure that our Elections were Fair and Honest. Tina is sitting in a Colorado prison for the “crime” of demanding Honest Elections,” Trump said.

Following the pardon, far-left Attorney General Phil Weiser appeared on local media to rage against Trump, conveniently while also running for governor.

Asked whether the pardon would free Peters, Weiser snapped: “No. This is a lawless act. It’s an act of intimidation. It has no basis in American law.”

Weiser insisted that Trump has no authority to interfere with Colorado’s prosecution, claiming Trump “doesn’t respect the rule of law” and boasting that he has sued Trump “45 times and counting.”

Kyle Clark:
First off, will this work? Will President Trump’s pardon actually free Tina Peters?

Phil Weiser:
No. This is a lawless act. It’s an act of intimidation. It has no basis in American law. Our system of government gives states authority to run their own criminal justice systems.

As you noted, there was a trial, there is a conviction by a jury, and there’s an appeal to the state courts. All of that is happening under the rule of law. This president doesn’t respect the rule of law, but he doesn’t have the authority to undermine how we operate our judicial system here in Colorado.

Kyle Clark:
We have seen this on a number of issues where, essentially, the Trump administration will take action and dare a court to tell them that it is illegal. My question for you is: are we seeing a legal maneuver, or do you view it as something else?

Phil Weiser:
This president apparently thinks he can pressure and bully people to his will. That’s not going to work in Colorado, because we honor the rule of law and believe in a system of justice that has existed in America since we became a republic—a system in which, no matter who you know and no matter what party you are, you are accountable to the law. That’s how we’re going to operate in Colorado. We’re not going to give in.

I’ve had to sue this president 45 times and counting because we keep getting these lawless demands, and we’re winning again and again. Those who cave in—those who are folders—are the ones who end up sacrificing. But as long as we stand strong, enforce the law, and do what’s right, we’re going to honor the system of justice we have here in Colorado.

Kyle Clark:
You’re the only attorney in this conversation, but I’m curious what you make of the legal theory being put forward by Peters’ team.

It strikes me that, for laypeople watching this, we at least understand there are some things that are established law, some things that are questionable and haven’t really been tested, and then theories that are just totally off the wall. Where do you believe Peters’ team’s legal theory falls on that spectrum?

Phil Weiser:
This is an off-the-wall theory. It’s total garbage. Any lawyer who argues in favor of this should be embarrassed and ashamed. We’ve had our system under the Constitution since 1789. The president has had a pardon power since then, and no president has ever tried to do this. This is unprecedented.

There’s no basis in the text of the Constitution or in its history. We need to uphold our constitutional system. We need to uphold the rule of law. That’s the basis of our democratic republic. We obviously will fight and resist this, and there’s no legal authority for it in the Constitution.

I just, for the life of me, don’t understand why this president isn’t willing to do what every other president has done—frankly, even during the first Trump administration—which is to ask lawyers, “Can we do this?” As you noted, there are some issues that are beyond the pale and have no basis in law. This is one of them.

Kyle Clark:
AG Weiser, I have a final question for you. Practically speaking, what happens if representatives of Tina Peters and/or the president show up at the state prison in Pueblo tonight or tomorrow and say, “Tina Peters is coming with us”? Will she be released by the state of Colorado while this plays out?

Phil Weiser:
No. There’s no legal authority for any federal government action to take a prisoner who is in state custody after being lawfully tried, convicted, and sentenced. This is an important principle of our Constitution.

Everyone who says they care about the rule of law, public safety, and our Constitution needs to care about this issue. Benjamin Franklin said, when he left the Constitutional Convention, “We have a republic, if you can keep it.” This is one of those moments.

In May, Trump directly condemned Colorado Attorney General Phil Weiser, accusing him of ignoring violent crimes committed by illegal aliens while targeting a peaceful grandmother.

“Radical Left Colorado Attorney General Phil Weiser ignores Illegals committing Violent Crimes like Rape and Murder in his State and, instead, jailed Tina Peters, a 69-year-old Gold Star mother who worked to expose and document Democrat Election Fraud,” Trump said on Truth Social in May.

“Tina is an innocent Political Prisoner being horribly and unjustly punished in the form of Cruel and Unusual Punishment. This is a Communist persecution by the Radical Left Democrats to cover up their Election crimes and misdeeds in 2020,” Trump wrote.
