Trump’s lawyers have argued that the order infringes upon his First Amendment rights. However, prosecutors have argued that such safeguards are necessary to protect the integrity of the materials. They have pointed out that Trump has a history of attacking witnesses, investigators, prosecutors, and others involved in legal proceedings against him. They stressed that they were not seeking a gag order against Trump but just wanted to ensure he did not misuse their evidence.
Trump has been charged with 34 felony counts of falsifying business records related to hush money payments to adult film star Stormy Daniels and another woman during his 2016 presidential campaign. He has pleaded not guilty and denied having extramarital affairs.
Trump’s legal team has also filed paperwork seeking to have the case transferred to federal court, claiming bias from Bragg and Merchan. The request is currently pending.
